    Can someone please explain this green belt to me. The swanky claim says no digging in the green belt 20 feet from bank. The river is at most 40 feet wide so if no digging within 20 f=t of bank then there's no digging.

       Welcome Chris, don't hold your breath waiting for help from the GPAA, the leadership wont even respond to you. The rest of us will say...Contact President Trump and tell him you feel that your 1872 Mining Act rights are being violated by environmental extremists who have an anti-American agenda. Ask him for help...Then write the same letter to our new Interior Sec...Then write it again to your Senator and your Congressman. Maybe hire a lawyer and file complaint after complaint to the Liberals who are making these rules.

     

        You have to do it yourself, if you wait for help from the GPAA...You'll be very disappointed with them. The GPAA leadership doesn't do or say much at all. Sorry to say...You're on your own with this one. We all have the same problem, mine is the San Gabriel Mountains East Fork River. Currently the Rangers are threatening to arrest Gold panners, and the GPAA leadership has said and done nothing about it.

     

        You might get help from Shannon Poe at AMRA. He's a leader & he gets stuff done while others do nothing.

    HI Adam I answer when I am available as with others within the company. With respect to the 1872 mining law it has issues when you thy to administer it to private land owners that own both the mineral and surface rights. Swank property is a private property that is leased by GPAA. The 20 foot is from the banks edge going away from the river or creek. This is a stipulation of the land / mineral rights owner. At GPAA we hold to respecting citizens rights to what they own so that is the reason for the 20 foot area of no digging.



    The East Fork was removed from mineral entry before WWII so the mining law had little effect, with help from Jerry Hobbs as well as GPAA and many other organizations in the area we-all were able to keep it open for people to dig and recover gold. When the executive order was signed for the monument enactment the only action would be from congress. There were letters and actions to keep use of the area but without Congressional support to reverse the executive order there is little to be done. Maybe some of the National Monuments will be reversed but Trump has not addressed that except to say that he will reverse all executive orders that are unconstitutional. If that is the reasoning I doubt if the monuments are on his radar sorry to say. This is not to say that I personally do not think that the extent of the executive orders now a days is an overreach that was never intended by the framers and possibly not the congress when it was added for the purpose of the enactment of the monuments under the Antiquities Act.

    Thanks Walter, wasn't thinking away from the river. With dealing with property owners on my own, I've never really thought of digging holes on their property. I guess that's why it didn't register.

    I know Chris, we all get use to what we do and it rather narrows what we look for. I have caught myself doing that many a time. It can get a bit confusing between claims under BLM, claims under a state through state owned property, BLM or Forestry recreational sites that allow limited mineral entry, and property leased or used by permission of the owner of the property and mineral which also includes pay to dig sites that may have rules based around gathering a royalty by what you find.

      Thanks for the clarification Walter. I'm wondering if the 20' bank rule was imposed on the claim owner by the radical environmentalists officials who think 'they' can control your property rights. I'm hearing this 20' foot bank rule is in a lot of claim locations.

     

         And I hope President Trump reverses the San Gabriel Mountains Monument just to piss off the environmentalists who want to ban off roading, Gold panning, and the militant Democrats want to get rid of the Burro Canyon shooting range as well.

    Just a note concerning exec orders. If I remember right they were how Teddy R. was able to extablish a large batch of our National Parks. So not all Exec orders are abused...just the last few decades.

      That's true, Teddy Roosevelt kicked Gold miners out of Yosemite to make it a Natl. Park...And Barry Obama considered having fewer Americans enjoy Yosemite. They don't want cars or motorhomes or new trails, or anything else in Yosemite.

    It can vary, on the east coast we have leases that are private property. Some of them the owners have leased farming along side the mining areas that they own outright. Also in other areas where there are water flows that raise in spring runoffs or summer rains cutting into the banks can cause a river diversion. This can be very dangerous in area where there are houses or high water control structures down stream. On public land that is locatable it is usually ten feet not twenty feet. Some times there are issues that have made it more restrictive for some kind of environmental issue also.

    In Yosemite I can remember camping there in a tent or camper with parents, use to enjoy the fire falls, they were great.

      I've seen the old videos of the Yosemite fire falls, but that ended before I could see it. I was there in 1988 & 2016. A good tip for everybody...Go to Yosemite in November, the Summer crowds were gone, no snow. It was sunny, the temps. were 50* to 65* and it was shorts & tee shirt weather all day & night. The French Toast at the Yosemite Lodge was awesome.

     

       A Yosemite trivia question for everybody...The Grand Majestic hotel & the movie 'The Shining' have what in common...Anybody...Anybody.

    Chris, To make it real easy for you: Both the east and west Swank claims prohibit digging in the bank. FOr both claims, digging should be restricted to the river bed itself. The river bed extends to the normal high water level of the river. Rule of thumb, if you're not sure -don't dig. We have a fantastic property and do not want to jepardize our lease.
