    This is a pre or "Advanced Notice Of PROPOSED RULE-MAKING" This is the time to alter thoughts, before the proposal.

    On September 13, 2018 the United States Department of Agriculture’s Forest Service published an Advance Notice of Proposed Rulemaking in the Federal Register to start the process of revising the Forest Service Locatable Minerals Regulations, 36 CFR 228 Subpart A, and request comments. We invite you and your organization to learn more about our revision plans and to submit comments by October 15, 2018.

    The Advance Notice and associated background information can be found at the Federal eRulemaking Portal: http://www.regulations.gov/. In the Search box, enter FS-2018-0052, which is the docket number for this Advance Notice of Proposed Rulemaking. Then, in the Search panel on the left side of the screen, under the Document Type heading, click on the Notice link to locate the Advance Notice and other information.     You may submit comments by clicking on “Comment Now” on the eRulemaking page (preferred method) or by mailing them to USDA-Forest Service.     Quick question....is this on a forest level, or a state or national effort?

     

    Never mind, this is a national change, looks like they want to align USFS regs for casual use, NOI, and POO more in line with BLM regs.  Could be a good thing, and in comments also include that individual Ranger Districts and Forests interept what is on the books with their own biased slant.

    USDA Forest Service national level. This could be good but has the potential to be very bad. It is an open book at this point except for a few things I picked up. Think they are pushing for everything to be a notice level, maybe with bond maybe only by owner. If you can think of the most stringent of "POLICIES" with the forest service, this could be an avenue to make it official and nation wide. This would also entail a waiting period with an NOI with bond as in some areas already policy.

    Might be right....then again with current administration in power.....

     

    Best outcome would be for USFS to get out of the mineral end altogether and turn over all mineral responsibilty to BLM since they already do all the claim work on USFS ground.

    I agree with that but there has been talk about converging the two, scary thing is not sure who would be the agency to take over. I am surprised that there has not been much interest in proactively directing these proposed regulations. Saw this in the beginning of the CA dredging - most said that they could never stop dredging in CA - we know how that turned out.
