    Hi all, this is from Dave Mack with the New 49"s.....

     

     I am very happy to inform you that the Third Appellate Court of
    California issued a unanimous Decision today confirming our
    arguments that a State agency does not have the authority to
    materially interfere with commercial mining programs on the public
    lands. The Decision reversed Brandon Rinehart's conviction for
    suction dredging without a permit. In case you are interested,

    This is a huge win for our side, which I believe, will go a long
    way towards getting us a reasonable set of dredging regulations
    in California for the 2015 season and beyond.  I also predict
    this will, in a roundabout way, help eliminate Oregon's moratorium
    which is set to begin in 2016.

    I'll follow with more in the October newsletter.  For now, I want
    to thank you guys for all your important support, and congratulate
    you on the biggest legal win for our side since the beginning of
    all the legal battles about 10 years ago!!

    This is a huge win for our side. The fight is not over though the greenies still want to shut us down in every state across America, we have to reverse the damage they have caused us in places like Tennessee, Maine, Oregon, Washington and so on.

    Does this mean the no-dredge moratorium is over in the state of CA, or does this just pertain to Brandon Rinehart's case?

    The decision simply reversed Brandon Rinehart’s conviction for dredging without a permit, in which he was fined $600 and sentenced to three years probation. We have posted an update on this story under News on the GPAA website and we have been updating it with reaction from Public Lands for the People as well. An update on the California dredging ban case is included in the article. The court-ordered Mandatory Settlement Conference continues Sept. 30 and Oct. 1. Hope this explanation helps, John. Be sure to check out the full story under news. A new, more accurate version of the story should be posted momentarily. I just finished writing it and will continue to update it as the story develops. Thanks for all you efforts to protect mining rights back East, John.
